Privacy Policy

This Privacy Policy explains how Vape City (“Vape City,” “we,” “us,” or “our”) collects, uses, and shares information about you when you visit vapecity.us (the “Site”), fill out our forms, join our in-store loyalty program, or sign up for our text messages. Vape City operates stores in Texas, Oklahoma, and Florida. By using the Site or our programs, you agree to this Privacy Policy.

The short version: We do not sell products online, and we do not sell your personal information. We never share your mobile phone number or text messaging consent with third parties or affiliates for their marketing.

1. Information we collect

Information you give us

  • Age check: To enter the Site, you go through an age check run by our provider, AgeChecker.Net. You may be asked for information such as your date of birth, name, address, or, in some cases, a photo of your identification. AgeChecker.Net handles this information under its own privacy policy. We may receive the result (for example, whether you passed).
  • “Join us!” sign-up and other forms: If you sign up through our pop-up or other forms, we may collect your name, email address, mobile phone number, ZIP code, preferred store, and date of birth (to confirm you are 21 or older).
  • Job applications: If you apply for a job on our Apply page, we collect what you send us, such as your name, contact information, address, work history, availability, desired location, references, and résumé. We use a form tool called WPForms to collect this information.
  • Loyalty program (in store): When you join Vape City Rewards in a store, we collect your name, phone number, and possibly email address and date of birth. We also keep a record of your in-store purchases, the points you earn, and the loyalty dollars you redeem. Our loyalty program runs on Lightspeed’s in-store sales system (Lightspeed X-Series).
  • Text messages: If you sign up for texts, we collect your mobile phone number (through our text messaging provider, SlickText), the date, time, and method of your consent, and your replies (such as STOP or HELP).
  • Contacting us: If you call us, we may keep notes about your request.

Information collected automatically

When you visit the Site, we and our service providers may automatically collect:

  • Your device and browser type, Internet Protocol address (the number that identifies your device online), and general location (such as city or state).
  • Pages you visit, links you click, how long you stay, and the website that sent you to us.
  • Information from cookies and similar tools (small files stored on your browser). See Section 5.

2. How we use your information

We use information to:

  • Confirm that you are 21 or older and keep the Site and our stores age-restricted.
  • Run the Site, fix problems, and understand how people use it so we can improve it.
  • Run our loyalty program, including tracking points and loyalty dollars.
  • Send you texts and other messages you agreed to receive, such as deals, store news, and rewards updates.
  • Review job applications and contact applicants.
  • Answer your questions and provide customer service.
  • Protect against fraud, security issues, and illegal activity.
  • Follow the law and enforce our Terms of Service.

3. How we share your information

We do not sell your personal information. We share information only in these limited ways:

  • Service providers who help us run our business and must protect your information and use it only to provide services to us. These include our age check provider (AgeChecker.Net), our in-store sales and loyalty system (Lightspeed), our website form tool (WPForms), website hosting, analytics (such as Google Analytics), and our text messaging provider (SlickText).
  • Legal reasons: When required by law, court order, or government request, or to protect the rights, safety, or property of Vape City, our customers, or others.
  • Business changes: If Vape City is part of a merger, sale, or similar transaction, information may be transferred as part of that deal, subject to this Privacy Policy.
  • With your permission: When you tell us to share it.

Mobile phone numbers and text messaging consent: We will never share, sell, rent, or trade your mobile phone number or your consent to receive text messages with any third party or affiliate for their marketing or promotional purposes. We share mobile information only with service providers that help us send our own messages (such as our text messaging platform, SlickText, and wireless carriers), and only to deliver those messages.

4. Text messages

If you sign up for Vape City Rewards/Alerts text messages, you agree to receive recurring automated marketing and informational texts at the number you gave us. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time, or HELP for help. See our full Text Messaging Terms for details.

5. Cookies and analytics

  • We may use cookies and similar tools to remember that you passed the age check, keep the Site working, and understand how visitors use the Site.
  • We may use Google Analytics, a service from Google that uses cookies to collect information about how you use the Site. You can learn how Google uses this information at https://policies.google.com/technologies/partner-sites and opt out with the Google Analytics opt-out browser add-on at https://tools.google.com/dlpage/gaoptout.
  • Most browsers let you block or delete cookies in their settings. If you do, some parts of the Site (such as the age check) may not work properly.
  • Some browsers send “Do Not Track” signals. There is no common standard for these signals, so the Site may not respond to them. If we begin using targeted advertising, we will honor recognized universal opt-out signals (such as Global Privacy Control) as Texas law requires.

6. How long we keep information

We keep information only as long as we need it for the reasons described in this policy, or as long as the law requires (for example, records of text message consent and job applications). When we no longer need it, we delete it or remove details that identify you.

7. How we protect information

We use reasonable administrative, technical, and physical safeguards to protect your information. No website or system is completely secure, so we cannot guarantee absolute security.

8. Your privacy rights

Your privacy rights may vary depending on the state where you live.

Texas residents

If you live in Texas, the Texas Data Privacy and Security Act gives you the right to:

  • Confirm and access: Find out whether we process your personal data and get a copy of it.
  • Correct: Ask us to fix inaccurate personal data.
  • Delete: Ask us to delete personal data you gave us or that we have about you.
  • Get a portable copy: Receive a copy of personal data you gave us in a format you can easily use, where technically possible.
  • Opt out: Tell us not to use your personal data for targeted advertising, sale, or profiling that leads to decisions with legal or similarly significant effects. (We do not sell personal data.)

Sensitive data: We do not collect or use sensitive personal data (such as precise location, health information, or government identification numbers) without your consent, except as allowed by law. Our age check provider may process identification documents to verify your age.

How to make a request: Call us at 832-844-1855 or ask at any Vape City store. We may need to confirm your identity before we act on your request. We will respond within 45 days. If we need more time, we may extend this by another 45 days and will tell you why. We will not charge you for requests, except as the law allows for repeated or excessive requests.

Appeals: If we deny your request, you may appeal by calling us at 832-844-1855 and saying you want to appeal. We will respond to your appeal within 60 days and explain our decision. If you disagree with our decision on appeal, you may contact the Texas Attorney General at https://www.texasattorneygeneral.gov/consumer-protection.

No discrimination: We will not treat you differently or deny you service for using your privacy rights. However, if you ask us to delete your loyalty information, we may not be able to keep your points or loyalty dollars.

Oklahoma and Florida residents

If you live in Oklahoma or Florida, you may have privacy rights under the laws of your state. To ask about your information or make a privacy request, call us at 832-844-1855 or ask at any Vape City store. We will respond as required by the law that applies to you.

9. Children and anyone under 21

The Site and our products are only for adults 21 and older. We do not knowingly collect personal information from anyone under 21, and we do not knowingly collect personal information from children under 13. If you believe someone under 21 has given us information, please call us at 832-844-1855 and we will delete it.

10. Links to other websites

The Site may link to other websites, such as social media pages or our age check provider. We are not responsible for their privacy practices. Please read their privacy policies.

11. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the new version on this page and update the effective date above. If we make major changes, we may also give notice on the Site.
