Terms of Service

Welcome to the Vape City website at vapecity.us (the “Site”). The Site is run by Vape City (“Vape City,” “we,” “us,” or “our”), which operates retail stores in Texas, Oklahoma, and Florida. These Terms of Service (“Terms”) explain the rules for using the Site. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. You must be 21 or older

  • You must be at least 21 years old to use this Site. Federal law prohibits selling tobacco and vapor products to anyone under 21, and the laws of Texas, Oklahoma, and Florida also set age rules for these products. Where a state or local law is stricter, our stores follow the stricter rule.
  • The Site uses an age check provided by AgeChecker.Net. By passing the age check, you confirm that you are 21 or older and that the information you give is true.
  • In our stores, staff will ask for a valid government-issued photo identification from anyone who looks under 30. We will refuse a sale if you cannot show valid identification proving you are 21 or older. We may also refuse a sale if we believe the product is being bought for someone under 21.

2. We do not sell products online

  • All products are sold in our stores only. You cannot buy, order, reserve, or pay for products on this Site.
  • Anything shown on the Site (products, flavors, brands, prices, deals, or availability) is for general information only. It is not an offer to sell. Products, prices, and deals may differ by store and may change at any time without notice.
  • Not every product is available at every location. Please call us or visit a store to check availability.

3. How you may use the Site

You may use the Site for your own personal, lawful, non-commercial purposes, such as finding a store, learning about our products and rewards program, or applying for a job. You agree not to:

  • Use the Site if you are under 21, or help anyone under 21 get around the age check.
  • Give false information, including on the age check, job applications, or sign-up forms.
  • Break any law while using the Site.
  • Copy, scrape, or collect content or data from the Site using automated tools without our written permission.
  • Try to hack, disrupt, overload, or gain unauthorized access to the Site or its systems.
  • Upload viruses or other harmful code.
  • Pretend to be someone else or misrepresent your connection with any person or company.

We may suspend or block your access to the Site at any time if we believe you have broken these Terms.

4. Loyalty program, job applications, and text messages

  • Vape City Rewards (loyalty program): You sign up for our loyalty program in a store. Points you earn on in-store purchases can be converted into loyalty dollars to use on future in-store purchases. The program’s rules, including how points are earned and redeemed, are set in store and may change. Loyalty points and loyalty dollars have no cash value and cannot be sold or transferred, unless the law requires otherwise.
  • Job applications: If you apply for a job through the Apply page, you agree that the information you give is true and complete. Submitting an application does not guarantee an interview or a job.
  • Text messages: If you agree to receive text messages from us, our Text Messaging Terms also apply.

5. Our intellectual property

The Vape City name, logos, designs, text, photos, graphics, and other content on the Site belong to Vape City or to the companies that license them to us. They are protected by trademark, copyright, and other laws. Other brand names and logos on the Site belong to their owners. You may not copy, change, share, sell, or use any of this content without our written permission, except to view and print pages for your own personal use.

6. Links to other websites

The Site may link to websites run by others (for example, our age check provider or social media pages). We do not control those websites and are not responsible for their content or practices. Please read their terms and privacy policies.

7. Health and product disclaimers

  • WARNING: Products sold in our stores may contain nicotine. Nicotine is an addictive chemical.
  • Nothing on the Site is medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease, and are not offered as a way to quit smoking. Talk to a doctor if you have health questions.
  • Keep products away from children and pets.

8. The Site is provided “as is”

We try to keep the Site accurate and working, but we cannot promise that it will always be available, error-free, secure, or up to date. To the fullest extent the law allows, the Site and all content are provided “as is” and “as available,” without warranties of any kind, whether stated or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Store hours, locations, and product information may contain errors.

9. Limitation of liability

To the fullest extent the law allows, Vape City and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, that come from your use of (or inability to use) the Site, even if we were told such damages were possible. Some laws do not allow certain limits on liability, so some of these limits may not apply to you.

10. Your responsibility to us

To the extent the law allows, you agree to defend and repay Vape City for any claims, losses, or costs (including reasonable attorney’s fees) that come from your misuse of the Site or your breaking these Terms.

11. Texas law applies

These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and change the effective date above. If you keep using the Site after changes are posted, you accept the updated Terms.

13. Other terms

If any part of these Terms is found unenforceable, the rest will still apply. If we do not enforce a part of these Terms, that does not mean we give up the right to enforce it later. These Terms, along with our Privacy Policy and Text Messaging Terms, are the full agreement between you and us about the Site.
